Terms of Service
These Terms of Service ("Terms") govern your access to and use of the AEMFix website, applications, APIs, and WordPress plugin (collectively, the "Service"), operated by AEMFix ("we", "us", "our"). By creating an account, joining the waitlist, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
AEMFix provides AI search visibility monitoring, keyword and content-opportunity analysis, automated content generation optimized for answer engines, and publishing integrations for platforms such as WordPress, Webflow, and Shopify.
2. No Guarantee of AI Placement or Search Rankings
We want to be explicit about this: no tool can deterministically guarantee a future AI output. AI assistants and search engines (including ChatGPT, Perplexity, Gemini, and Google) generate responses that vary between runs and change over time, and they are operated by third parties we do not control. For this reason, AEMFix tracks your share of voice over time instead of promising placement. We do not guarantee that your brand will be mentioned, cited, recommended, or ranked by any AI engine or search engine, and no statement on our website or in the Service constitutes such a guarantee.
3. Accounts
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
4. Subscriptions, Trials, and Billing
- Paid plans are billed monthly or annually in advance through our payment processor.
- Plans may include a free trial (for example, 7 days). A valid payment method may be required; you will be charged automatically when the trial ends unless you cancel before it does.
- You can cancel anytime from your account settings. Cancellation takes effect at the end of the current billing period, and you retain access until then.
- Fees are non-refundable except where required by law or expressly stated otherwise. Because generating content and running AI visibility scans incurs significant third-party costs, usage already consumed is not refundable.
- We may change pricing with at least 30 days' notice; changes apply from your next billing cycle.
5. Acceptable Use
You agree not to: use the Service for unlawful, deceptive, or fraudulent purposes; scan or publish to websites you do not own or lack authorization to manage; attempt to probe, disrupt, or reverse-engineer the Service; resell the Service without written permission; or use the Service to generate content that is defamatory, infringing, or otherwise unlawful.
6. Your Content and Generated Content
You retain ownership of your website data and materials you provide. Subject to your subscription being in good standing, we assign to you the rights we hold in content generated by the Service for your account. You are responsible for reviewing generated content before or after publication and for its accuracy, legality, and suitability. AI-generated content may contain errors; final editorial responsibility rests with you.
7. Third-Party Services
The Service relies on third-party providers, including AI model APIs, search-data providers, hosting, payments, and the platforms you connect (for example WordPress, Webflow, Shopify). Their availability, output, and terms are outside our control, and your use of connected platforms remains subject to their own terms.
8. Intellectual Property
The Service, including its software, design, branding, and documentation, is owned by us or our licensors and is protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your business purposes.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Without limiting Section 2, we do not warrant any particular marketing, traffic, visibility, or revenue outcome.
10. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim arising out of the Service is limited to the amounts you paid us in the 12 months preceding the claim.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, non-payment, or abuse of usage limits. Sections that by their nature should survive (including 2, 6, 8, 9, 10) survive termination.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of [Jurisdiction], without regard to conflict-of-law rules. Disputes will be resolved in the courts of [Jurisdiction].
